FLSA Rules on Salaried Employee Proration
The federal Fair Labor Standards Act strictly governs exempt salaried compensation under the "salary basis rule". Employers cannot arbitrarily dock exempt employees for partial day absences, but specific legal exceptions apply to onboarding and departures:
Under 29 C.F.R. § 541.602(b)(1), an employer does not violate the salary basis test by paying an exempt employee a proportionate part of their full salary for the time actually worked in their first week.
When an employee resigns or is terminated mid-period, the final paycheck is legally prorated based on the exact hours or business days worked prior to departure.
